Refund Policy
Last updated: October 2026
1. Scope of this policy
This refund policy applies to the services provided by MADAUS Capital Partners GmbH, Triftstraße 13, 80538 München, Deutschland (“MADAUS”, “we”). Our website serves exclusively to provide information about our company and our services. We do not sell goods, digital content or services through this website, and no orders or payments can be placed or made via this website.
2. Fees and contractual basis
The services of MADAUS — in particular financial portfolio management, investment brokerage and investment advice within the meaning of Section 15 of the German Securities Institutions Act (WpIG) — are provided exclusively on the basis of individually concluded mandate or service agreements. All fees, invoicing terms, payment schedules and any provisions on the reimbursement or refund of fees are set out in the respective agreement concluded with each client. Mandatory statutory provisions of German and European law remain unaffected.
3. Statutory right of withdrawal for consumers (14 days)
If you are a consumer within the meaning of Section 13 of the German Civil Code (BGB) and conclude a contract with us by means of distance communication (for example by letter, telephone or e-mail), you generally have a statutory right of withdrawal in accordance with Sections 312g and 355 BGB and Directive 2011/83/EU on consumer rights.
Withdrawal period
You have the right to withdraw from the contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day of the conclusion of the contract.
How to exercise the right of withdrawal
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by an unequivocal statement, sent by post to MADAUS Capital Partners GmbH, Triftstraße 13, 80538 München, Deutschland, or by e-mail to info@madaus.com. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. You may use the model withdrawal wording set out below, but it is not obligatory.
Effects of withdrawal
If you withdraw from the contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in no event will you be charged any fees as a result of such reimbursement.
If you expressly requested that we begin providing the services before the end of the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time at which you inform us of your exercise of the right of withdrawal, compared with the full coverage of the contract (Section 357a BGB).
Exceptions
The right of withdrawal does not apply, or expires early, in the cases provided for by law — in particular for contracts for financial services whose price depends on fluctuations in the financial market outside our control and which may occur within the withdrawal period (Section 312g (2) BGB), and for contracts that have been fully performed by both parties at your express request before you exercise your right of withdrawal.
Model withdrawal wording
“I/We (*) hereby withdraw from the contract concluded by me/us (*) for the provision of the following service (*). Concluded on (*). Name of the consumer(s). Address of the consumer(s). Date. Signature of the consumer(s) (only if this form is notified on paper). (*) Delete as appropriate.”
4. Voluntary refunds beyond statutory rights
Beyond mandatory statutory rights, any refund — for example of fees paid in advance — is governed by the individual agreement concluded with you. Where the agreement is silent, we examine refund requests on a case-by-case basis in good faith, taking into account the services already rendered and the expenses incurred. We will acknowledge receipt of a refund request within five business days and notify you of our decision within fourteen days. Approved refunds are paid by SEPA bank transfer to the account from which the original payment was made, within fourteen days of our approval, unless otherwise agreed with you.
5. How to request a refund or cancellation
Please address any refund or cancellation request to MADAUS Capital Partners GmbH, Triftstraße 13, 80538 München, Deutschland, by telephone at +49 89 37426790 or by e-mail to info@madaus.com. So that we can process your request without delay, please state your full name, your mandate or client reference, the date and amount of the payment concerned, and the reason for your request.
6. Complaints and dispute resolution
If you are not satisfied with how we handle a refund or cancellation request, you may use our complaints procedure at any time; details can be found on our Complaints Management page. Where applicable, you may also refer the matter to the competent arbitration board; further information is available on our Arbitration Board page. Your rights under mandatory statutory provisions remain unaffected.
7. Governing law
This policy is governed by the law of the Federal Republic of Germany. In the case of consumers, mandatory consumer protection provisions of the state in which the consumer has his or her habitual residence remain unaffected (Article 6 of the Rome I Regulation).
